(Objective)
Article 1
1. |
The mu-mo shop point rules (hereafter referred to as gThe Rulesh) stipulate the conditions for the provision by avex music creative Inc. (hereafter referred to as gThe Companyh) of mu-mo Shop Gold Service (hereafter referred to as gThe Serviceh) to members completing member registration (no-charge) based on the mu-mo Shop Service Agreement and Membership Agreement (hereafter referred to as gService and Membership Agreementh). |
2. |
Service and Membership Agreement are applied to matters related to the Service not stipulated by the Rules. |
(Granting of Gold)
Article 2
1. |
The Company, whenever members correspond to any of the following items (hereafter referred to as gTransactions in Question,h they will be granted gmu-mo Shop Goldh (hereafter referred to as gGoldh): |
(1) |
When members purchase goods designated by the Company |
(2) |
When members purchase goods covered by campaigns implemented from time to time by the Company; or |
(3) |
In other cases recognized by the Company |

The ratio of granting Gold and the expiration date thereof will vary by the type of transaction covered, and the Members will be notified of these details through this site. |
3. |
Gold will be granted after a certain period after the establishment of the Transactions in Question as stipulated by the Company. Within this time period, where the Company recognizes the cancellation or return with respect to the Transactions in Question, or where the Transactions in Question are not established for certain reasons, Gold will not be granted. |
4. |
Where there are changes in the prices of goods subject to the Gold, Gold will be granted based on the purchase price after the change. |
5. |
The final decision with respect to the grant of Gold, including whether Gold is granted, or the number of Gold granted, shall be made by the Company, and the Members shall follow these decisions.

6. |
Handling fees, shipping fees and consumption tax etc. shall not be covered by the granting of Gold. |
(Gold Management)
Article 3
1. |
The Company shall notify the Members of the number of Gold acquired by the Member, the number of Gold used by the Member and the balance of the number of Gold held be the Member through a method designated by the Company. |
2. |
The Company shall make final decisions related to the number of Gold held by the Members, and the Members shall follow these decisions. |
(Prohibition of Combining Gold)
Article 4
1. |
Members shall neither transfer nor pledge Gold held by them to other Members, nor share Gold among Members. |
2. |
In case where a Member holds multiple membership registration, the Member shall not combine the number of Gold held under each member registration. |
(Gold Cancellation and Expiration)
Article 5
1. |
In case where such circumstances as the Company deems it appropriate to cancel the granting of Gold arise after the Company grants Gold, including the return or cancellation with respect to the Transactions in Question the Company may cancel the Gold granted through the Transactions in Questions. |
2. |
Where the Member is deemed to fall under any of the following categories, the Company may cancel all or a portion of the Gold held by the Member: |
(1) |
The Member conducts illegal or improper actions; |
(2) |
The Member violates the Rules, Service Agreement or other rules stipulated by the Company; or |
(3) |
The Company decides it appropriate to cancel Gold granted to Members |
3. |
Gold will automatically expire where the Members will not conduct the Transactions in Question within the period stipulated by the Company. |
4. |
The Company makes no compensation for cancelled or expired Gold, and bears no responsibility. |
(The Use of Gold in Settlement—p)
Article 6
1. |
The Members may use their Gold for the settlement of all or a portion of purchase price (including the price of goods, shipping fees and handling fees) with respect to the transaction made through this site. |
2. |
The Company may restrict the services and goods for which Gold may be used as provided in the previous paragraph, and may place additional conditions for the use of Gold. |
3. |
When the Members cancel settlements as provided in the paragraph 1 of this Article, Gold which is used for such settlement will be returned in principle. |
4. |
When the Members use Gold for the settlements of entire amount of the payment, and the amount of that settlement is for any reason reduced after the settlement, Gold will be returned pursuant to the previous paragraph. |
5. |
When the Members use Gold for a portion of the settlement of the payment, and the amount of that settlement is for any reason reduced after the settlement, first payment will be returned through another payment method, and if even in that event the amount of funds required for the return is insufficient, Gold will be returned for the insufficient amount in question as listed in the previous item. |
(Use of Gold for Purposes Other than Settlements)
Article 7
1. |
The Members, in addition to the use of Gold for settlement of purchased goods as provided in the previous article, in a method stipulated by the Company, may exchange their Gold for prizes, services, participation in drawings, and for other privileges (hereafter referred to as gThe Privilegesh). |
2. |
The Privileges may be provided by an associated company delegated by the Company. In this case the usage of the Privileges shall follow the rules or stipulations of the individual associated companies, and the Company makes no guarantee of the quality or usefulness of the Privileges. Where there are defects in the Privileges, the Members shall resolve these with the associated company sending or providing the Privileges in question. |

The type and contents of The Privileges, required number of Gold required for exchange, and other Gold usage conditions shall be decided by the Company, and the Company may newly create, change, or terminate these stipulations at any time. It would be possible that the Privileges requested to exchange by the Member would not be provided due to the lack of inventory, the termination of the relationship with the associated company, or other reasons. In these cases, the Members will be asked to change the Privileges, or their Gold will be returned. However, this shall not applicable to the cases where the Members lose in drawings. |
4. |
When the Company creates the Privileges for which the Members may exchange Gold, it will notify them by a method as stipulated by the Company. |
5. |
The Company will make no compensation and bears no responsibility even if the Members are disadvantaged in any way by the reasons listed in paragraph 3 of this article. |
6. |
The Members, when using Gold, shall provide the shipping destination, contact information and other items stipulated by the Company for the Privileges. Where the Privileges such as presents are shipped to the Members, they will be shipped to the name of the Member at the address occupied by the Member him/herself within Japan. No shipments will be made overseas, to individual other than The Member, or to post office boxes, except as otherwise decided by the Company. |
7. |
The Members, with the exception of where the Company or the supplier of the Privileges is responsible, may neither return the Privileges nor exchange them for another Privileges. |
(Accidents etc)
Article 8
When accident, including delay, lost, steal, damage or broken occurs during shipment or after delivery with respect to goods subject to the settlement pursuant to Article 6 or the Privileges in Article 7, the Company will bear no responsibility and will not return Gold, except for the case where the Company is responsible for the accident. |
(Return of Gold)
Article 9
Where the Members use Gold for the settlement of payment for purchases or for the exchange for Privileges, and where the Transactions in Question subject to such settlement are later cancelled at the discretion of the company, in principle the Gold used will be returned to the Members. |
(The Cancellation of Gold after Use)
Article 10
1. |
Where the Members use Gold for settlements in accordance with Article 6, and Gold is cancelled in accordance with Article 5.1 or 5.2, the transaction for the settlement subject to such settlement (hereafter, gGold Usage Transactionh) may be cancelled or put on hold. Furthermore, where the Members have already used the Gold in question, the difference in the funds caused by the cancellation of the Gold will be registered as minus Gold, and this minus portion will be compensated by future Gold. |

Where the Members use Gold in exchange for the Privileges in accordance with Article 7, and the Gold is cancelled as provided in the previous paragraph, the request for the Privileges is cancelled. Where the Members have already received the Privileges, they shall promptly return the Privileges to The Company or pay an amount of money equivalent to the Privileges to the Company. |
(Expiration Date of Gold)
Article 11
1. |
Gold is valid until the expiration date separately stipulated by the Company. Furthermore, the expiration date of the Gold can be verified on the web page specifically assigned to each the Member. |
2. |
Where the Members do not use Gold by the expiration date, the Gold granted will expire immediately after the expiration date. |
(Prohibition of Conversion to Cash)
Article 12
The Members may not under any circumstances exchange Gold for cash. |
(Use by Third Parties)
Article 13
1. |
Gold may only be used by the Members themselves, and may not be used by any third parties. |
2. |
In case where the Company confirms that the e-mail address and password entered at the time of use of Gold matches those registered with the Company by a method as decided by the Company, the Company will deem that the Gold is used by the Member. In such case, even where that use is improper use by a third party, the Company will not return the used Gold, and the Company will also bear no responsibility for damages incurred by the Members. |
(Taxes and Fees)
Article 14
The Members will bear taxes or fees associated with the acquisition, use, and exchange of Gold. |
(Loss or Stoppage of Membership)
Article 15
Where the Members lose their status as the Members, they shall lose their rights to exchange Gold for the Privileges and all other rights relating to the usage of the Service, and shall not acquire any rights to request compensation from the Company as a result of the loss of their status. |
(Communication to the Members)
Article 16
The Company may use e-mail or the telephone to make notifications about Gold, or other campaigns related to Gold services, or emergency or important notifications to the Members, to which the Members give their prior consent. |
(Changes to The Service)
Article 17
1. |
The Company may make changes to The Rules, contents of the Service, or the conditions of the provision of the Service (including additional services, elimination of Gold, suspension of granting of Gold, and changes to the granting rate or usage rate of Gold) without prior notification to The Members, and may terminate or suspend the Service. The Members give their prior consent to this. |
2. |
The Company, where the Members are disadvantaged in any way by the changes in the previous item, bears no responsibility. |
Additional Rules
The Rules are effective from June 1, 2010. |
